End User Terms

Last updated: September 29, 2026

These End User Terms (the “Terms”) are between Jet Digital Inc. (“Jet Digital”, “we” or “us”), a British Columbia company, and you. They apply when you use JetStream to download or exchange files, whether through a web browser or the JetStream Client application (the “Client”). Part A applies to everyone. Part B also applies if you install the Client.

By checking the box or clicking to download, or by installing or using the Client, you agree to these Terms. If you are using JetStream on behalf of an organization, you confirm that you are authorized to accept these Terms for it, and “you” includes that organization. If you do not agree, do not download the files or use the Client.

Part A – All users

1. How JetStream works

JetStream is file transfer software. The organization that operates the JetStream server you are connecting to (the “Operator”), such as the company that sent you files or your employer, runs JetStream on its own servers or infrastructure. Jet Digital supplies the software but does not host, receive, review or control the files transferred, the download pages, or the information the Operator collects about you. Your relationship with the Operator, including how it handles your files and personal information, is governed by the Operator’s own terms and privacy policy. Questions about a particular transfer should be directed to the Operator.

2. Acceptable use

You will not use JetStream to:
a) send, receive or store any content that is unlawful, or that you do not have the right to access, copy or share;
b) introduce viruses, malware or other harmful code;
c) bypass or attempt to bypass passphrases, access controls or other security measures, or access files you are not authorized to access; or
d) interfere with the normal operation of JetStream.

3. Privacy

Jet Digital does not receive the files you download or the personal information the Operator collects when you use JetStream. The Operator is responsible for that information. The Client may send technical usage data to Jet Digital to help improve the product. Jet Digital’s handling of this data and any other personal information it receives is described in its Privacy Policy.

4. Open source software

JetStream includes open source software components that are licensed to you under their own license terms, not these Terms. Notices and license terms for these components are available under About → Software Licenses in the Client. Nothing in these Terms limits your rights under those licenses.

5. Feedback

If you send us suggestions or other feedback about JetStream, we may use it for any purpose without obligation to you.

6. No warranty

JETSTREAM IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, JET DIGITAL AND ITS SUPPLIERS AND LICENSORS DISCLAIM ALL WARRANTIES, CONDITIONS AND REPRESENTATIONS, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING THOSE OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND DO NOT WARRANT THAT JETSTREAM WILL BE ERROR-FREE OR UNINTERRUPTED. JET DIGITAL IS NOT RESPONSIBLE FOR THE CONTENT OF ANY FILES TRANSFERRED USING JETSTREAM, OR FOR THE AVAILABILITY OR OPERATION OF ANY OPERATOR’S SERVERS.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JET DIGITAL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS OR BUSINESS, ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF JETSTREAM, AND JET DIGITAL’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS WILL NOT EXCEED CAD $100.

8. Your statutory rights

Some laws, including consumer protection laws, give you rights that cannot be limited or excluded by contract. Nothing in these Terms limits those rights, and Sections 6, 7 and 13 apply only to the extent those laws allow.

9. Responsibility for your use

To the extent permitted by law, you are responsible for any third-party claims against Jet Digital that arise from content you transfer using JetStream or from your breach of these Terms.

10. Suspension

The Operator controls access to its JetStream server. Jet Digital may suspend or end your right to use the Client if you breach these Terms or if required by law.

11. Changes to these Terms

We may update these Terms from time to time. The updated Terms will be presented to you when you next download files or install or update the Client, and will apply from that point. The “Last updated” date above shows when these Terms last changed.

12. Export compliance

JetStream uses encryption technology. You will comply with all export control and sanctions laws that apply to your use of JetStream, including those of Canada and the United States.

13. General

These Terms are governed by the laws of British Columbia, Canada and the federal laws of Canada that apply there, and disputes will be resolved in the courts of Vancouver, British Columbia, subject to Section 8. If any part of these Terms is found unenforceable, the rest will continue in effect. These Terms are the entire agreement between you and Jet Digital about your use of JetStream as an end user. They do not change any agreement between Jet Digital and an Operator. Questions about these Terms can be sent to info@gojetstream.io.

Part B – JetStream Client

This Part applies if you install or use the Client, in addition to Part A.

14. License

Subject to these Terms, Jet Digital grants you a free, non-exclusive, non-transferable license to install and use the Client to send and receive files using JetStream.

15. Ownership

The Client, excluding the open source components described in Section 17, is owned by Jet Digital and its licensors and is protected by copyright and other intellectual property laws. You receive only the rights expressly granted in these Terms.

16. Restrictions

Except as permitted by Section 17 or by law, you will not:
a) copy the Client except as needed to install and use it;
b) modify, decompile, disassemble or reverse engineer the Client;
c) sell, rent, lease, sublicense or distribute the Client; or
d) remove or alter any copyright, license or other notices in the Client.

17. Open source components

The Client includes software components licensed by third parties under open source licenses (“Third-Party Components”), including the Qt framework, version 6.8.3, © The Qt Company Ltd. and contributors, licensed under the GNU Lesser General Public License version 3 (“LGPL”). Qt is a trademark of The Qt Company Ltd., and its inclusion in the Client does not imply any endorsement of Jet Digital or JetStream by The Qt Company Ltd. A list of the Third-Party Components and copies of their licenses, including the LGPL and the GNU General Public License version 3 that it incorporates, are provided in the Client and in its installation directory. The complete corresponding source code for Qt 6.8.3 is available at https://download.qt.io/archive/qt/6.8/6.8.3/.

In addition, for at least three (3) years after Jet Digital last distributes a version of the Client that includes a Third-Party Component whose license requires source code to be made available, you may obtain that source code by written request to info@gojetstream.io, for a charge no greater than Jet Digital’s reasonable cost of distribution. If these Terms conflict with the license of a Third-Party Component, that license prevails for that component.

Nothing in these Terms limits your rights under those licenses or imposes any restriction on a Third-Party Component beyond those its license permits. This includes, where the license permits, the right to modify a Third-Party Component, to replace the bundled library files (such as .dll, .so and .framework files) with other versions, including your own builds, and re-link them with the Client, and to reverse engineer the Client to the extent necessary to debug such modifications. In practice, this means you may reverse engineer the Client only as far as needed to debug changes you make to the Qt libraries or other Third-Party Components included with it, and not for any other purpose.

18. Updates

The Client may check for and install updates when you accept them. Updates are covered by these Terms unless they come with separate terms.

19. Ending the license

You may stop using and uninstall the Client at any time. Your license ends automatically if you breach these Terms, and you must then uninstall the Client. Part A and Sections 15 to 17 continue to apply after the license ends. Ending the license does not affect your rights under the license of any Third-Party Component.
